Con fundamento en lo dispuesto por los Artículos 1, 2, 3, 15, 16, 17, 28 y demás relativos y aplicables de la LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE LOS PARTICULARES le informamos que EL ZALATE THE ONE AND ONLY AC (en lo sucesivo el "Condominio"), con domicilio en 28 KM Carretera Transp. SJC-CSL, Condos El Zalate, Local numero 8, colonia La Jolla, en la ciudad de San José del Cabo, Municipio Los Cabos Baja California Sur , código postal 23450, en lo sucesivo el Responsable tratarán los datos personales que recabe de Usted, siendo responsable del uso que se le dé a los mismos y de su protección.

El Responsable de acuerdo a la actividad propia de su naturaleza, tratará su información personal con la finalidad de Identificación, Registro, Comunicación e Información de de todo lo relacionado con el Condominio, como enunciativa más no limitativamente, entre otros, puede ser: Contactarle de manera personal, telefónica y/o vía correo electrónico para informarle sobre cualquier situación o asunto del Condominio y/o de su Unidad de Propiedad Exclusiva, enviarle estados de cuenta, solicitar el pago de las cuotas y sanciones a su cargo, información sobre los servicios con los que cuente el Condominio, así como para el uso o disfrute de cualquier actividad o servicio que facilita el Condominio a sus condóminos, visitantes, trabajadores y cualquier persona que ingrese al Condominio.  También la información podrá ser utilizada en el sitio del Web publicado para los dueños del Condominio.   Dicha sitio únicamente tendrá acceso con una contraseña personalizada por cada dueño.

Para alcanzar las finalidades antes mencionadas, se tratar án entre otros, los siguientes datos personales los que se describen a continuación de manera enunciativa más no limitativa : nombre(s) y apellidos, estado civil, ocupación, fecha y lugar de nacimiento, números telefónicos, correo electrónico, domicilio (dentro y fuera del condominio ), nacionalidad, firma, registro federal de contribuyentes (RFC), clave única de población (CURP), estado civil, imagen de documentos de identificación oficiales y de escritura de propiedad (o fideicomiso traslativo de dominio, según sea el caso ).

EL ZALATE THE ONE AND ONLY, AC no recaba ningún tipo de datos personales sensibles, considerados como tales, aquellos que puedan revelar aspectos como origen racial o étnico, estado de salud presente y futuro, información genética, creencias religiosas, filosóficas y morales, afiliación sindical, opiniones políticas, preferencia sexual, etc.

Nos comprometemos a limitar y evitar la divulgación de su información, a no transferir su información personal a terceros sin su consentimiento, salvo las excepciones previstas en el Artículo 37 de la LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE LOS PARTICULARES, así como a realizar esta transferencia en los términos que fija dicha ley.

Con fundamento en lo dispuesto por el Artículo 28 y demás relativos y aplicables de la LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE LOS PART ICULARES, Usted tiene derecho de (i) Acceder a sus datos personales, en nuestro poder, y conocer los detalles del tratamiento de los mismos, (ii) Rectificarlos, en caso de ser inexactos o incompletos, (iii) Cancelarlos cuando considere que no se requieren para alguna de las finalidades señaladas en el presente Aviso de Privacidad, estén siendo utilizados para finalidades no consentidas o haya finalizado la relación contractual o de servicio, o (iv) Oponerse al tratamiento de los mismos que para tal fin nos haya otorgado, a través del procedimiento de Ejercicio de Derechos ARCO implementado por la LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE LOS PARTICULARES para tal fin. Para conocer dicho procedimiento, los requisitos y plazos, se puede poner en contacto con nosotros vía correo electrónico a la dirección elzalate@paamanagement.com para darle tramite a su solicitud para el ejercicio de los anteriores derechos.

Asimismo, le informamos que sus datos personales pueden ser transferidos y tratados por el Responsable, incluyendo todos los órganos del condominio, su personal, y profesionales externos contratados por la administración del condominio , en términos del presente Aviso de Privacidad

El Responsable se reserva el derecho de efectuar, en cualquier momento, modificaciones o actualizaciones al presente Aviso de Privacidad, en el entendido de que toda modificación al mismo se le hará saber a Usted por medio de un comunicado vía correo electrónico.

En caso de que ocurra una vulneración de seguridad en cualquier fase del tratamiento de datos personales que afecte de forma significativa sus derechos patrimoniales o morales, se le comunicará de forma inmediata mediante un comunicado vía correo electrónico el suceso de vulneración de seguridad, para que Usted pueda tomar las medidas necesarias correspondientes para la defensa de sus derechos.

Based on the provisions of Articles 1, 2, 3, 15, 16, 17, 28 and others related AND APPLICABLE, FEDERAL LAW OF PROTECTION OF PERSONAL DATA IN POSSESSION OF PRIVATE INDIVIDUALS, we inform you that the EL ZALATE THE ONE AND ONLY AC (hereinafter referred to as the "Condominium"), with its registered office at 28 km Carretera Transp. SJC-CSL , Condos El Zalate, Local number 8, Col. La Jolla, in the city of San Jose del Cabo , Municipality of Los Cabos, Baja California Sur , Zip Code 23450 (hereinafter referred to as the "Responsible Party "; during the gathering of personal data from you, being responsible for the use given to them and their protection.

"The Responsible Party” according to the activity of their nature, will treat your personal information for the purpose of identification, registration, Communication and Information about everything related to the Condominium, as for example, but without limitation, among others, may be: contact you in person, by telephone and/or via e-mail to inform you about any situation or subject of the Condominium and/or your exclusive property, send you statements of account, a request for the payment of fees and penalties, information about the services that the Condominium may have, as well as for the use or enjoyment of any activity or service that facilitates the condominium to their owners, visitors, workers and any person entering the Condominium. The information may also be used on the website published for the owners of the Condominium. This site will only have access via a personalized password for each owner. 

To achieve the aims mentioned above, we treat among others, the following personal data described below but not limited to: name(s) and surname, marital status, occupation, date and place of birth, telephone numbers, email addresses, mailing address ( inside and outside of the condominium ), nationality, signature, Federal Taxpayers Registry (RFC), unique population key (CURP), marital status, images of official identification documents and property deeds ( or trusts, fideicomisos traslativo domain name, as the case may be ).

El ZALATE THE ONE AND ONLY, AC does not collect any sensitive personal data which are considered as such, those which can reveal aspects such as racial or ethnic origin, state of health, present and future, genetic information, religious beliefs, philosophical and moral, union membership, political opinions, sexual preference, etc .

We commit ourselves to limit and prevent the disclosure of your information, not to transfer your personal information to third parties without your consent.

On the basis of the provisions of article 28 and others related AND APPLICABLE, THE FEDERAL LAW OF PROTECTION OF PERSONAL DATA IN POSSESSION OF PRIVATE INDIVIDUALS, you have the right to (i) access to your personal data in our possession, and to know the details of the treatment of the same, (ii) to rectify them, in case of incorrect or incomplete information, (iii) cancel your changes when you think you are not required for any of the purposes outlined in this Privacy Notice, are being used for purposes not consensual or completed the contractual relationship or service, or (iv) to object to the processing of the same as for this purpose have given us, through the exercise of ARCO Rights implemented by the FEDERAL LAW OF PROTECTION OF PERSONAL DATA IN POSSESSION OF PRIVATE INDIVIDUALS for this purpose. In addition, we inform you that your personal data may be transferred and treated by the Responsible Party, including all the organs of the condominium, its staff, and external professionals hired by the administration of the condominium, in terms of this Privacy Notice.

The Responsible Party reserves the right to make, at any time, modifications or updates to this Privacy Notice, with the understanding that any modification to the same will made known to you by means of a statement via email.

In the event of a breach of security in any phase of the processing of personal data that significantly affect your rights, you will be informed immediately through a statement via email in the event of a breach of security, so that you can take the necessary measures for the defense of your rights, as the case may be.
